Consumer

For the purposes of these terms and conditions, “consumer” means an individual who neither makes this contract in the course of a business, nor holds himself out as doing so, as defined by the Unfair Contract Terms Act 1977. If you deal as a consumer any provision of this contract which is of no effect to a consumer shall not apply. Your statutory rights are not affected by this contract.

By submitting an order to sell a device on our site you must be:

  1. A resident of the UK

  2. Accessing the site from within the UK

  3. Legally capable of entering in to a binding contract

  4. At least 18 years old or have obtained consent from your parent or guardian to sell the device for the sum indicated via our website

On completing the order form for each device, you will be provided with an offer for your device. The order form must be completed accurately and you must update us if any information changes. If the order form information is not accurate you may not receive the full offer price.

Ecofone  reserves the right to claim any handset that we haven’t heard back on following e-mail communication to the registered e-mail address after 5 calendar days. You will be paid the value sent via e-mail.

Ecofone reserves the right to refuse any handset or device at any time without notice.

Ecofone reserves the right to update you at any time, via your supplied contact details. This can be via, mail, SMS, e-mail or phone call.

Before sending us a device

Before sending us any device, please read these terms and conditions carefully and ensure you have printed a copy for future reference.

All devices must:

  1. Be owned by you

  2. Be complete with no missing parts including battery / battery cover

  3. Have any PIN lock, ‘Activation Lock’ or iCloud Lock deactivated and removed prior to shipping – if any lock is enabled, we won’t be able to test the device as we will be unable to access any of the functions and the device will be deemed inoperable. Therefore, we will only be able to offer you 5% of the value.

  4. Not be crushed, bent in half or heavily liquid damaged

  5. Not be ‘jail-broken’ or have similar firmware alterations

  6. Be in its original manufactured condition (i.e. no replacement parts)

Data Risks and Precautions

Please remember you are responsible for cancelling any contract linked to each device. Please ensure any SIM and data cards have been removed prior to sending us your device. Any SIM or data cards received by us will be securely destroyed on receipt and will not be returned. We accept no liability for any charges which may be incurred if any device is sent to us with SIM or data cards. You will be responsible for all such charges.

Although we offer data removal certification with all devices where supported and technically possible we accept no responsibility in relation to the confidentiality, protection, security or use of any data remaining on the device when sent to us and it is your responsibility to ensure any such data is removed prior to sending to us. This includes any form of personal details, SMS, photos, games, songs or other data.

Please note it may not be possible to remove data from your non-functional device (faulty). If you send us a non-functional device you are therefore accepting that data may be accessible to any person who repairs the device. This may include any third party that the device is forwarded to for spare parts/harvesting and/or disposal.

Pricing

All pricing offered on our website is subject to change at any time without notice and is inclusive of any VAT and other taxes which may be applicable.

All pricing will be guaranteed for 30 days from the order placed date. This is the date we send you the confirmation email and shipping details for your order. If your device is received after this period the current website price will apply. To avoid disappointment, we will remind you during the 14-day guarantee period.

If your device does not match your order criteria due to grading or functionality we will contact you with a revised offer. Revised offers will automatically be processed for payment if we do not receive feedback within 72 hours.

Grading of Devices

Each device will be tested using industry leading device Blackbelt Defence diagnostic software and must pass as fully functional to be classed as a working device. This means all original features must be in full working order and show no signs of defect. Any functional defect with the device will result in the device being classed as faulty. Please see the below grading system for devices.

Good
  • It should work flawlessly
  • No major damage (i.e chips or cracks to the screen or phone)
  • No water damage
  • Light wear and tear acceptable
  • Good battery health (above 80%)
  • No custom engraving
Poor
  • It should work flawlesly should
  • Heavy signs of wear & tear (i.e chips or cracks to the screen or phone)
  • May have custom engraving
  • No water damage
  • Good battery health (above 80%)
Faulty
  • Your device shows signs of heavy damage
  • May have a cracked screen, deep scratches
  • It can be water damaged or has some software faults.
  • The device must not be bent or crushed. It should power up.
  • Poor battery health (below 80%)

We cannot accept iCloud and or password locked devices.

They must be de-registered (removed) from any  iCloud (Find my iPhone/iPad) accounts.

Please note:
  • We accept phone battery chargers and accessories. We will not be able to return accessories or original packaging (box) if you request your phone to be returned.

  • You are responsible for cancelling any airtime contract linked to each handset. We are not responsible for any call costs arising before, or after, receipt of your handset, or arising from any other circumstances whatsoever.

  • Please ensure you remove your SIM card before sending us your mobile phone. We accept no liability in the event that a SIM card is sent with a phone and charges are then incurred. You shall continue to be responsible for such charges. Any SIM cards received by us are non-returnable.

  • Please remember that by sending your phone to us, you agree to release us from all and any claims, losses or damages with respect to the phone, any data stored or contained therein or on any media used in conjunction with the phone (whether in the form of personal details, SMS, photos, games, songs or other data (“Data”)). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from the phone prior to you sending it to us. 

3. Payments and Checking Process

During the checkout process you will be asked for your bank details to receive payment. We assume no responsibility whatsoever for the validity of the details that you provide and it is your sole responsibility at all times to ensure the payment details provided are correct.

When we receive your sale items, we will check that the sale is complete, and that it meets our terms and conditions.

If your device(s) does not fit the category you chose, we’ll propose an adjusted price by email in accordance with the condition categories. If you choose to decline our new offer, we are happy to return the phone for free. We have the final decision on all device values. Adjusted orders will be automatically processed for payment if you do not reply to our proposed offer via email within 5 calendar days.

Important – under no circumstances accept your decision via email or by telephone. All decisions must be submitted via the decision link sent to you by email.

We assume no responsibility whatsoever for the validity of the details that you provide, and it is your sole responsibility at all times to ensure the payment details provided on the website are correct. Please double check these before you proceed.

Should you enter the incorrect payment details, please notify us and we’ll ensure we request an investigation with the banks.

We will not be liable for any losses that you may suffer if you fail to receive payment if a payment is sent to an incorrect account or recipient, as a result of any failure by you to correctly submit payment details when using the website.

Provided your device(s) meets our terms and conditions we will issue the payment to you on the same day of completing checks. Any payment discrepancies must be reported to us via email (payments@ecofone.co.uk) within 30 days of the payment date. As a result, any issues after this period will not be actioned and payment will not be re-issued.

Ecofone reserves the right to destroy any lost / stolen handsets that appear on the “CheckMend” database if they haven’t been claimed by their subsequent owners after 28 days. UK legislation states that we cannot under any circumstances return or pay for a mobile phone or device which is registered lost or stolen at any time unless the lost or stolen records associated with it are cleared. If we at any time become aware of any issues, you will be required to co-operate with the authorities and we reserve the right to withhold or cancel the payment.

All items are purchased using the VAT margin scheme as per the HMRC used goods VAT rules

4. Postage  

We provide you with a Freepost Royal Mail 48 hour Label. This service is only applicable when posting up to 2 devices at a time. This will require you to take your package, with handsets / gadgets and sales order to a Royal Mail post office to obtain proof of postage and a tracking number.

We cannot be held responsible for any items that aren’t returned via Royal Mail and subsequently lost within the mail system for items being sent to us. We will of course claim if returned handsets dispatched from us don’t arrive with you. Unfortunately, other than when we arrange courier collection on your behalf, we do not accept responsibility for non-delivery of phones or damage in transit. We therefore recommend that you send any high value units via registered special delivery post to ensure successful deliver, please remember to keep the receipt and tracking number.

For each package you send in it is your responsibility to:

  • Ensure it is adequately insured for loss in transit, and

  • Ensure that it is adequately physically protected.

Ecofone accepts no liability for any loss sustained due to inadequate packaging when our supplied return bags are used.

Ecofone cannot be held responsible for the non-delivery of emails because of spam email or junk filters. Please check your junk and spam folders. This is also noted on our order emails.

Ecofone reserves the right to claim any handset that we haven’t heard back on following e-mail communication to the registered e-mail address after 5 calendar days. You will be paid the value sent via e-mail.

5. Events outside of our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.
